Terms of service

These Terms of Service (“Terms”) govern your access to and use of thecentrecap.com (the “Website”) and any purchases made through the Website.

The Website and The Centre Cap brand are operated by Karajeh Trading FZC LLC, a company registered in the United Arab Emirates (“The Centre Cap”, “we”, “us” or “our”).

By accessing the Website, creating an account, placing an order, or otherwise using our services, you agree to these Terms together with our Privacy Policy, Return & Refund Policy, Shipping Policy and any other policies referenced on the Website.

Nothing in these Terms limits or excludes any rights that cannot lawfully be limited or excluded under applicable consumer protection law.

1. About The Centre Cap

The Centre Cap is an independent aftermarket retailer of automotive replacement parts and accessories, including wheel centre caps, emblems and badges. All products sold by The Centre Cap are aftermarket parts and accessories, not genuine vehicle-manufacturer parts.

The Centre Cap is not affiliated with, endorsed by, sponsored by or officially connected with any vehicle manufacturer referenced on this Website.

Vehicle manufacturer names, model designations, trademarks and logos belong to their respective owners and are referenced to identify vehicle compatibility and describe or show the replacement products offered for sale.

2. Eligibility to Use the Website

You must have the legal capacity to enter into a binding purchase agreement.

If you are under 18 years of age, you should use the Website and make purchases only with the involvement and authorization of a parent or legal guardian.

You may not use the Website or our products for any unlawful or unauthorized purpose.

3. Products

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications, quantities and other information displayed on the Website are accurate.

Because vehicle parts may vary between models, production years, trim levels, wheel designs and previously replaced or modified components, customers should review the complete product information before ordering.

Product photographs are intended to represent the product being sold as accurately as reasonably possible. The appearance of colours, finishes or materials may vary slightly depending on lighting, photography and the display settings of your device.

Material characteristics and minor manufacturing tolerances may also result in small variations between individual products. Such variations do not permit us to supply a materially different product from the one described or shown.

We may update or discontinue products and may change product descriptions where appropriate. Changes will not alter the product already purchased under a completed order without your agreement.

4. Vehicle Compatibility and Fitment

Compatibility information provided on the Website is intended to help customers identify the correct replacement part.

Fitment can depend on factors including:

  • vehicle model, generation or chassis code;
  • production year;
  • wheel style or wheel manufacturer;
  • whether the vehicle has original or aftermarket wheels;
  • the dimensions of the existing centre cap or emblem;
  • retaining-clip size or configuration;
  • badge diameter;
  • pin, hole or mounting configuration;
  • original or replacement part number; and
  • modifications or previously replaced vehicle components.

A vehicle model and production year alone do not always guarantee that every wheel, centre cap, badge or emblem fitted to that vehicle is identical.

You are responsible for measuring your existing centre cap or badge and comparing its dimensions and fixing configuration with the product specifications before ordering. Vehicle model and year information alone may not guarantee fitment.

If you are uncertain about fitment, we recommend contacting us before ordering and providing the relevant vehicle and part information.

Compatibility information is provided based on the product and vehicle information reasonably available to us. It should not be interpreted as overriding clearly conflicting physical measurements or part specifications.

Nothing in this section limits your rights where we supplied the wrong product, the product is defective, or compatibility information provided by us was materially inaccurate or misleading.

5. Test Fitting and Installation

You should inspect the product before permanent installation.

Where reasonably necessary to confirm fitment, a product may be carefully test-fitted provided doing so does not damage, alter or materially reduce the resale condition of the product.

You should not force a centre cap, badge or emblem into position if it does not fit correctly.

Before confirming that you intend to keep a product, you should avoid actions that cannot reasonably be reversed, including removing adhesive backing where applicable, permanently bending or altering retaining clips, modifying the product, applying glue or other adhesives, drilling, cutting, painting or permanently attaching the product to the vehicle.

The Centre Cap is not responsible for damage caused by forced or incorrect installation, modification, misuse, accidents, impacts, improper maintenance or use of a product in a manner inconsistent with its intended purpose, except where responsibility cannot lawfully be excluded or where the damage results from a defect for which we are responsible.

6. Orders and Contract Formation

When you submit an order through the Website, you are making an offer to purchase the products included in that order.

Receipt of an automated order confirmation means that we have received your order. It does not necessarily mean that the order has been finally accepted.

We may review an order before dispatch for reasons including payment verification, suspected fraud, product availability, incorrect pricing, shipping restrictions or errors in the order information.

An order is accepted when we confirm that it has been accepted for fulfilment or dispatch the order.

If we are unable to accept an order after payment has been collected, the affected amount will be refunded using the original payment method where reasonably possible.

We may reasonably limit quantities or reject orders that appear fraudulent, unlawful, placed for unauthorized resale, or otherwise inconsistent with these Terms.

7. Prices and Payment

Product prices are displayed on the Website in the applicable currency shown to you.

The final amount payable, including applicable delivery charges and any taxes or other charges collected by us, will be displayed during checkout before you submit your order.

Prices may change at any time, but a later price change will not affect an order that we have already accepted.

Payments may be processed by Shopify and/or other third-party payment providers. Your use of a payment method may therefore also be subject to the terms and privacy practices of the relevant payment provider.

You confirm that you are authorized to use the payment method provided for an order.

If a product is displayed at an obviously incorrect price because of a technical, typographical or system error, we may contact you before fulfilment to allow you to purchase at the correct price or cancel the affected item and issue a refund.

We will not substitute a different price after an order has been accepted without informing you.

8. Product Availability

Products are subject to availability.

Although we make reasonable efforts to keep stock information accurate, a product may occasionally become unavailable after an order has been submitted.

If an ordered product cannot be supplied, we may cancel the affected product or order and issue the appropriate refund.

We are not required to substitute a different product without your agreement.

9. Shipping and Delivery

Orders are shipped in accordance with our Shipping Policy, which forms part of these Terms.

Estimated processing and delivery times are estimates rather than guaranteed delivery dates unless we expressly state otherwise.

Delivery times may be affected by circumstances outside our reasonable control, including customs processing, carrier delays, severe weather, public holidays, transportation disruption and incorrect or incomplete delivery information.

Customers are responsible for providing a complete and accurate delivery address.

If an order cannot be delivered because the customer supplied materially incorrect or incomplete delivery information, additional reasonable delivery or return costs may apply where permitted by law.

International orders are shipped with duties and taxes unpaid (DDU). Applicable customs duties, import taxes, clearance charges and other destination fees are payable by the recipient to the relevant authority or carrier.

Please review our Shipping Policy for further information.

10. Returns, Refunds and Incorrect Products

Returns, exchanges and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

Where an eligible product is being returned because the customer changed their mind or ordered an incorrect size or variant despite accurate product information being provided, return shipping obligations will be handled according to the Return & Refund Policy.

Where we send the wrong product, the product arrives defective or damaged, or the product is materially different from its description, we will handle the matter in accordance with our Return & Refund Policy and applicable consumer law.

Any requirement that a customer inspect or report an issue within a particular period is intended to help us investigate the issue promptly and does not remove statutory rights that cannot legally be limited.

A customer's reasonable use of a product solely to inspect it or determine whether it is defective or suitable for the represented fitment will be considered in accordance with applicable law and our Return & Refund Policy.

11. Order Cancellations

If you wish to cancel an order, contact us as soon as possible.

We may be able to cancel an order that has not yet entered fulfilment or been dispatched.

Once an order has been dispatched, cancellation or return will normally be handled under our Return & Refund Policy.

Nothing in this section affects any mandatory cancellation or withdrawal rights that apply under the law governing a particular transaction.

12. Promotions and Discount Codes

From time to time we may offer promotions, discount codes, bundle offers or other incentives.

Unless otherwise stated, promotional offers:

  • are subject to availability;
  • cannot be exchanged for cash;
  • may be limited to one use per customer or order;
  • may exclude particular products or regions; and
  • may not be combined with other offers.

Any additional terms displayed with a promotion will apply to that promotion.

We may cancel or correct a promotion where it was published in error, used fraudulently or abused contrary to its stated conditions.

13. Intellectual Property

Except for third-party trademarks, product marks and other intellectual property belonging to their respective owners, the Website and its original content are owned by or licensed to Karajeh Trading FZC LLC.

This includes, where applicable, The Centre Cap name and branding, website design, original graphics, photographs created for us, written content, guides, databases and other proprietary material.

You may use the Website for personal shopping and informational purposes.

You may not reproduce, scrape, republish, commercially exploit, distribute or create derivative works from our proprietary Website content without our prior written authorization, except where permitted by law.

Nothing on the Website transfers ownership of any intellectual property right to you.

14. Third-Party Trademarks

Vehicle manufacturer names, model designations, trademarks and logos referenced on the Website belong to their respective owners and are used to identify vehicle compatibility and describe or show the replacement products offered for sale.

All our products are aftermarket, not genuine vehicle-manufacturer parts. The Centre Cap is not affiliated with, endorsed by, sponsored by or officially connected with those vehicle manufacturers.

15. Customer Reviews, Images and Submissions

If you voluntarily submit a product review, photograph, video, comment or other content to us or through the Website, you confirm that you have the right to submit that content.

You must not submit content that is unlawful, fraudulent, defamatory, abusive, misleading, infringing, obscene, malicious or that violates another person's intellectual property or privacy rights.

You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and use content that you voluntarily submit for the operation and promotion of The Centre Cap, subject to applicable privacy and consumer laws.

Where reasonably practicable, you may contact us if you wish to request removal of content you submitted.

We may remove customer content that violates these Terms or applicable law.

16. Third-Party Services and Links

The Website may use or link to services provided by third parties, including payment providers, shipping providers, analytics services, social networks and other technology providers.

A link to a third-party website does not necessarily mean that we endorse or control that website.

Third-party services may be governed by their own terms and privacy policies.

To the extent permitted by law, The Centre Cap is not responsible for the independent content, security, availability or conduct of third-party websites or services that we do not control.

17. Prohibited Uses

You must not use the Website:

  • for unlawful, fraudulent or deceptive activity;
  • to violate another person's intellectual property, privacy or other legal rights;
  • to upload malicious software or interfere with Website security;
  • to gain unauthorized access to accounts, systems or data;
  • to submit materially false information;
  • to conduct abusive automated scraping or extraction that materially interferes with the Website;
  • to impersonate another person;
  • to engage in payment fraud, chargeback fraud or other fraudulent transactions; or
  • to use the Website in a manner that violates applicable law.

We may restrict or terminate access where reasonably necessary to protect the Website, our customers, our business or third parties from unlawful or abusive conduct.

18. Website Availability and Errors

We aim to keep the Website available and accurate but do not guarantee that it will operate continuously or without technical errors.

We may temporarily suspend access for maintenance, security, updates or circumstances outside our reasonable control.

Occasionally, information may contain typographical, technical or administrative errors relating to descriptions, compatibility, availability, delivery information or prices.

We may correct such errors when discovered.

If an error materially affects an order you have already placed, we will take reasonable steps to inform you and provide any remedy required under these Terms or applicable law.

19. Consumer Rights and Product Conformity

Products supplied by The Centre Cap must comply with the description and obligations applicable to the transaction under relevant law.

Nothing in these Terms is intended to remove rights you may have where a product:

  • is defective;
  • arrives damaged;
  • is incomplete;
  • is not the product ordered;
  • materially differs from its description;
  • does not meet compatibility information expressly represented by us; or
  • otherwise fails to meet a mandatory legal requirement.
  • If there is a conflict between these Terms and a mandatory consumer protection right that cannot legally be waived, the mandatory consumer protection right will prevail.

20. Disclaimer

The Centre Cap provides replacement automotive appearance and fitment products.

Our products are aftermarket replacement parts and accessories, not genuine vehicle-manufacturer parts.

Compatibility information is intended to assist customers, but vehicle and wheel configurations can vary. Customers are responsible for measuring their existing part and checking the product dimensions and fixing configuration before ordering.

Nothing in these Terms constitutes professional mechanical, engineering or vehicle-safety advice.

No statement in these Terms excludes any express product representation made by us on the relevant product page or any statutory guarantee, warranty or consumer right that cannot legally be excluded.

21. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer protection law.

Subject to the above, The Centre Cap will not be responsible for losses caused solely by:

  • improper or forced installation;
  • customer modification of the product;
  • use of a product on a vehicle or wheel for which it was not represented as compatible;
  • inaccurate measurements or vehicle information provided by the customer;
  • misuse, accident, collision or external damage after delivery; or
  • circumstances outside our reasonable control.

To the maximum extent permitted by applicable law, we will not be liable for indirect or consequential business losses arising from a consumer purchase where such losses were not reasonably foreseeable at the time of purchase.

These limitations do not apply where the loss results from fraud, deliberate misconduct, gross negligence where liability cannot lawfully be excluded, or a defective or misdescribed product for which we are legally responsible.

22. Fraud and Security

We may use reasonable fraud-prevention and security measures when processing orders.

Where an order presents a credible fraud or security risk, we may request additional verification, refuse the transaction or cancel the order.

Any payment already collected for an order cancelled by us for security reasons will be handled in accordance with applicable law and the relevant payment-provider process.

23. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By using the Website, you acknowledge that your personal information may be processed as described in that policy and as necessary to process orders, provide customer support, prevent fraud and operate the Website.

24. Events Outside Our Reasonable Control

We will not be responsible for a delay or failure to perform an obligation where the delay or failure results from circumstances outside our reasonable control and where applicable law permits such limitation.

Such circumstances may include major carrier disruption, natural disasters, government action, war, civil disturbance, widespread telecommunications or infrastructure failure, customs disruption, epidemics or other comparable events.

We will take reasonable steps to reduce the effect of such circumstances where practicable.

Your mandatory rights relating to delayed or undelivered goods remain unaffected.

25. Suspension or Termination of Website Access

You may stop using the Website at any time.

We may suspend or restrict access where reasonably necessary because of unlawful conduct, fraud, security concerns, abuse of the Website or material breach of these Terms.

Termination or suspension of Website access does not remove rights or obligations relating to orders or transactions that occurred before termination.

26. Severability

If any provision of these Terms is determined by a competent authority to be invalid, unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

27. No Waiver

If we do not immediately enforce a right under these Terms, that does not mean we have waived that right.

A waiver of one breach does not constitute a waiver of any later breach.

28. Entire Agreement

These Terms, together with the policies and information expressly incorporated into them, constitute the terms governing your use of the Website and purchases from The Centre Cap.

Product-specific information displayed on a product page also forms part of the information on which the relevant purchase is based.

If a product-specific representation conflicts with generic Website wording, mandatory consumer law and the specific representation made in connection with the purchased product will be taken into account.

29. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, Website, services, products or applicable legal requirements.

The current version will be published on this page with its latest revision date.

Changes will apply prospectively from the date they are published unless applicable law requires otherwise.

Changes to these Terms will not retrospectively remove rights arising from an order already accepted.

30. Governing Law and Jurisdiction

These Terms and purchases made from The Centre Cap are governed by the applicable laws of the United Arab Emirates.

Disputes shall be subject to the jurisdiction of the competent courts of the United Arab Emirates, except where mandatory consumer protection or jurisdiction rules applicable to a particular customer provide otherwise.

Nothing in this section deprives an international customer of mandatory consumer rights that apply to them and cannot lawfully be excluded by agreement.
